___________________ moved that SB 141 be amended as follows:

     On the printed bill, delete everything after the enacting clause and insert:

"      Section 1. That chapter 34-23A be amended by adding thereto a NEW SECTION to read as follows:

     The Legislature finds that human life begins at conception and that no unborn human life may be deprived of any appropriate inherent right or due process guaranteed by the Bill of Rights of the State Constitution. The Legislature further finds that because each unborn human life represents a potential citizen of the state and nation, the state has a substantial interest in protecting the life, health, and welfare of each innocent unborn human life and may, to that end, confer and confirm certain rights, protection, and dignities upon innocent unborn human life.

     Section 2. That chapter 22-16 be amended by adding thereto a NEW SECTION to read as follows:

     No person may intentionally destroy or terminate any unborn human life except as provided in section 3 of this Act. Any violation of this section is a Class A felony.

     Section 3. That chapter 22-16 be amended by adding thereto a NEW SECTION to read as follows:

     The provisions of section 2 of this Act do not apply if the pregnancy:

             (1)    Comes to represent a substantial and immediate physical danger to the life of the mother; or

             (2)    Was the result of rape or incest.

     However, the provisions of this section do not supercede any applicable procedural provision of chapter 34-23A."
