FOR AN ACT ENTITLED, An Act to make an appropriation to the Department of Game, Fish and Parks to provide for the purchase and land exchange of properties held by the Office of School and Public Lands and to declare an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. There is hereby appropriated from the general fund the sum of two million five hundred thousand dollars ($2,500,000), or so much thereof as may be necessary, to the parks and recreation fund to allow the Department of Game, Fish and Parks to purchase properties owned by the Office of School and Public Lands that will become part of a land exchange agreement with the United States Forest Service to establish a state park at Spearfish Canyon in Lawrence County, which includes Bismarck Lake, to be managed and maintained in perpetuity for the benefit of the public. The Department of Game, Fish and Parks may also use the appropriation to pay for survey and any administrative costs relating to the land exchange. If the federal land proposed in the land exchange is of greater value than the state land, the Department of Game, Fish and Parks may use any portion of the appropriation exceeding the purchase price paid to the Office of School and Public Lands for a payment to the secretary of
the United States Department of Agriculture to equalize the exchange land values.
Section 2. There is hereby appropriated the sum of two million five hundred thousand dollars ($2,500,000), or so much thereof as may be necessary, of other fund expenditure authority to the Department of Game, Fish and Parks for expenditures authorized by this Act.
Section 3. The secretary of the Department of Game, Fish and Parks shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized by this Act.
Section 4. Any amounts appropriated in this Act not lawfully expended or obligated shall revert in accordance with the procedures prescribed in chapter 4-8.
Section 5. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
