        FOR AN ACT ENTITLED, An Act to require certain wind energy facilities to include aircraft detection lighting systems.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That chapter 49-41B be amended by adding a NEW SECTION to read:
    For any wind energy facility that receives a permit under ยง 49-41B-25 the facility shall be equipped with an aircraft detection lighting system that is installed, operated, and maintained in compliance with performance standards set forth by the Federal Aviation Administration for obstruction marking and lighting in effect as of January 1, 2019. Any cost associated with the installation, operation, or maintenance of a system under this section is solely the responsibility of any owner of the wind energy facility.
