        A CONCURRENT RESOLUTION, Commending Taiwan's presidential election; supporting Taiwan's efforts to secure entry to the Trans-Pacific Partnership (TPP) and the signing of the Free Trade Agreement (FTA) and the Bilateral Investment Agreement (BIA) with the United States; and reaffirming support for increasing Taiwan's international profile and for strengthening and expanding sister-state ties between South Dakota and Taiwan.

    WHEREAS, the State of South Dakota is proud of the sister-state relationship it has enjoyed with Taiwan since 1984 marked by strong bilateral economic, social and cultural exchange, and tourism; and

    WHEREAS, Taiwan shares the same values of freedom, democracy, human rights, the rule of law, peace, and prosperity with the United States and the State of South Dakota; and

    WHEREAS, on January 16, 2016, Taiwan held its sixth direct presidential election, demonstrating again the strength and vitality of its democratic system and confirming that Taiwan is a beacon of democracy in Asia and beyond; and

    WHEREAS, the United States ranks as Taiwan's third largest trading partner, Taiwan is the tenth largest trading partner of the United States, and bilateral trade reached $67.4 billion in 2014; and

    WHEREAS, every other year, Taiwan has sent an agricultural trade goodwill mission to the United States midwestern region, including South Dakota, to demonstrate Taiwan's continuing goodwill and willingness to purchase South Dakota agricultural products and the South Dakota agricultural industry has benefited greatly over the past two decades from the sale of beef, wheat, and corn to Taiwan; and

    WHEREAS, the commercial interaction between South Dakota and Taiwan has grown substantially with each passing year, resulting in increased economic growth for both Taiwan and South Dakota; and

    WHEREAS, negotiations for a bilateral investment agreement between Taiwan and the United States are an important step toward further strengthening bilateral trade and paving the way for entering into a free trade agreement between our countries, thereby increasing South Dakota's exports to Taiwan and creating bilateral investment through tariff reduction and other trade facilitation measures; and

    WHEREAS, Taiwan, seeking to contribute to greater regional integration in the Asia-Pacific region and promotion of bilateral investment and trade relations with the United States, applauds the United States' announcement to expand TPP membership in the future to include other countries, such as Taiwan; and

    WHEREAS, Taiwan's inclusion in the TPP would contribute substantially to the depth, viability, and quality of the TPP. Additionally, Taiwan's strong economic weight in the Asia-Pacific and the world, its well-developed knowledge base and highly skilled workforce, its vital position along regional supply chains, and the positive economic and strategic gains for all make Taiwan an ideal candidate economy for the TPP's expansion:

    NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the Ninety-First Legislature of the State of South Dakota, the Senate concurring therein, that the Legislature commends and supports Taiwan's mature and vital democracy as well as celebrates the thirty-second anniversary of sister-state relations with Taiwan; endorses the signing of the Bilateral Investment Agreement (BIA) and Free Trade Agreement (FTA) with the United States; and continues to support Taiwan's appropriate participation in international organizations which impact the health, safety, and well-being of its people.

    HCR 1016 Introduced by: Representatives Schrempp, Bartling, Bordeaux, Feickert, Gibson, Hawks, Hawley, Killer, and McCleerey and Senators Heinert, Bradford, Buhl O'Donnell, Hunhoff (Bernie), Peterson (Jim), and Sutton

        A CONCURRENT RESOLUTION, Expressing and encouraging support for the continued use of country-of-origin labels on meat products sold to consumers.

    WHEREAS, in 2008 the United States Congress passed a mandatory country-of-origin labeling for muscle cuts of meat sold at retail, which required meat produced in the United States from imported livestock to bear a different label than meat produced from United States born livestock; and

    WHEREAS, in 2013 the United States Department of Agriculture issued new regulations that provided additional information to the consumer on where meat was born, raised, and harvested; and

    WHEREAS, trade groups and the organizations representing multinational meatpackers worked predominantly with Canada, as well as Mexico, to bring a World Trade Organization (WTO) case against the United States for the removal of the labeling requirements; and

    WHEREAS, in May 2015 the WTO issued a final ruling that the United States' country-of-origin labeling regime was out of compliance with WTO regulations because it required the segregation of imported animals; and

    WHEREAS, Canada and Mexico have asked the WTO for permission to retaliate against the United States for damages that have yet to be proven; and

    WHEREAS, Doctor Robert Taylor, of Auburn University, issued a study in February of 2015 demonstrating that Canadian and Mexican beef feeder and fat cattle markets were not affected by country-of-origin labeling and that feeder cattle and fat cattle imported from both Mexico and Canada were not affected by the country-of-origin labeling; and

    WHEREAS, consumers have repeatedly and overwhelmingly expressed their support for country of origin labeling of food products in the United States:

    NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the Ninety-First Legislature of the State of South Dakota, the Senate concurring therein, that the Legislature will continue to support consumers' right to know where their food comes from and support the use of country-of-origin labels.

        A CONCURRENT RESOLUTION, Commending the nation of Israel for its cordial and mutually beneficial relationship with the United States and with the State of South Dakota.

    WHEREAS, Israel has been granted her lands under and through the oldest recorded deed, as recorded in the Old Testament scriptures held sacred and revered by Jews and Christians alike, as presenting the acts and words of God; and

    WHEREAS, the claim and presence of the Jewish people in Israel has remained constant throughout the past four thousand years of history; and

    WHEREAS, the legal basis for the establishment of the modern state of Israel was a binding resolution under international law, which was unanimously adopted by the League of Nations in 1922 and subsequently affirmed by both houses of the United States Congress; and

    WHEREAS, this resolution affirmed the establishment of a national home for the Jewish people in the historical region of the land of Israel, including the areas of Judea, Samaria, and Jerusalem; and

    WHEREAS, Article 80 of the United Nations Charter 22 recognized the continued validity of the rights granted to states or peoples which already existed under international instruments, and therefore the 1922 League of Nations resolution remains valid, and the six hundred fifty thousand Jews currently residing in the areas of Judea, Samaria, and eastern Jerusalem reside there legitimately; and

    WHEREAS, Israel declared its independence and self-governance on May 14, 1948, with the goal of reestablishing its God-given and legally recognized lands as a homeland for the Jewish people; and

    WHEREAS, the United States, having been the first country to recognize Israel as an independent nation and as Israel's principal ally, has enjoyed a close and mutually beneficial relationship with Israel and her people; and

    WHEREAS, there are increasing incidents of anti-Semitism around the world, including across the United States reflected in official hate crime statistics; and

    WHEREAS, the international boycott, divestment, and sanctions movement is one of the main vehicles for spreading anti-Semitism and advocating the elimination of the Jewish State; and

    WHEREAS, the dramatic increase in boycott, divestment, and sanctions campaign activities on college campuses around the country has resulted in increased animosity and intimidation against Jewish students, negatively impacting student programming related to the State of Israel and politics in the Middle East; and

    WHEREAS, leaders of the boycott, divestment, and sanctions movement say their goal is to eliminate Israel as the home of the Jewish people; and

    WHEREAS, messaging at anti-Israel rallies has adopted the boycott, divestment, and sanctions slogan: "from the river to the sea Palestine will be free" which means that there would be no Israel between the Jordan River and Mediterranean Sea and that the State of Israel will cease to exist; and

    WHEREAS, Israel is the greatest friend and ally of the United States in the Middle East and the values of our two nations are so intertwined that it is impossible to separate one from the other; and

    WHEREAS, there are those in the Middle East who have continually sought to destroy Israel, from the time of its inception as a state, and those same enemies of Israel also hate, and seek to destroy, the United States; and

    WHEREAS, the promise of the God of Israel, who is the God stated in our Constitution, is that He will bless those who bless Israel, and be it known that the State of South Dakota openly blesses Israel with gratitude for our cordial and mutually beneficial relations since 1948, a friendship that continues to strengthen with each passing year:

    NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the Ninety-First Legislature of the State of South Dakota, the Senate concurring therein, that the Legislature commends Israel for its cordial and mutually beneficial relationship with the United States and with the State of South Dakota, supports Israel in its legal, historical, moral, and God-given right of self-governance and self-defense upon the entirety of its own lands, and recognizes that Israel is neither an attacking force nor an occupier of the lands of others, and that peace can be afforded the region only through a whole and united Israel; and

    BE IT FURTHER RESOLVED, that the secretary of the House of Representatives prepare copies of this resolution and forward them to the President of the United States, the speaker and clerk of the United States House of Representatives, the president and secretary of the United

States Senate, and the Israeli Embassy in Washington D.C. for transmission to the proper authorities in the State of Israel.

    On page 5 of the House State Affairs Committee engrossed bill, delete lines 3 to 7, inclusive, and insert "The applicant is subject to the original license fee established by § 54-4-40. If the application of an existing licensee is for an additional location, the application need only include the location and identity of the location manager, plus any changes from the existing license, and any other information the director considers necessary.".

    On page 6, delete lines 18 to 24, inclusive, and insert:

"    A license expires on December thirty-first. To renew a license, the licensee shall submit an application for renewal by December first. The renewal application is subject to the renewal fee established by § 54-4-40, proof of surety bond, and any other information as required by the director, by rule or order. Any licensee that submits an application for renewal after December first but before January first of the next calendar year is subject to the late fee established by § 54-4-40. After December thirty-first, no license may be issued unless an application is filed pursuant to section 12 of this Act.".

    On the printed bill, delete everything after the enacting clause and insert:

"    Section 1. That the code be amended by adding a NEW SECTION to read:

    The use of racially derogatory or discriminatory school or athletic team names, mascots, nicknames, logos, imagery, or celebrations depicting Native Americans and Native American culture is prohibited in any public school district.

    Section 2. That the code be amended by adding a NEW SECTION to read:

    The provisions of this Act do not apply to any public school district that:

            (1)    Is located on or near an Indian reservation;

            (2)    Serves a student population of which at least fifty percent is comprised of Native American students; and

            (3)    Obtains the written permission of the government of the federally recognized tribe with tribal land closest to the school district to use the school or athletic team name, mascot, nickname, logo, imagery, or celebration depicting Native Americans and Native American culture.

    Section 3. That the code be amended by adding a NEW SECTION to read:

    Any public school district using a school or athletic team name, mascot, nickname, logo, imagery, or celebration depicting Native Americans and Native American culture prohibited in section 1 of this Act shall discontinue its use.

    Section 4. That the code be amended by adding a NEW SECTION to read:

    Notwithstanding the provisions of section 3 of this Act, a public school district may continue to use uniforms or other materials bearing the racially derogatory or discriminatory term or imagery that were purchased prior to the effective date of this Act for a period of no longer than five years if the public school district meets the following requirements:

            (1)    The school selects a new school or athletic team name, mascot, nickname, or logo;

            (2)    The school refrains from purchasing or acquiring, for the purpose of distribution or sale to students or school employees, any uniform that includes or bears the racially derogatory or discriminatory term or imagery;

            (3)    The school refrains from purchasing or acquiring, for the purpose of distribution or sale to students or school employees, any yearbook, newspaper, program, or other

similar material that includes or bears the racially derogatory or discriminatory term or imagery in its logo or cover title; and

            (4)    The school refrains from purchasing or constructing a marquee, sign, or other new or replacement fixture that includes or bears the racially derogatory or discriminatory term or imagery, and for any existing facility which bears the racially derogatory or discriminatory term or imagery, the school shall remove the prohibited name or imagery no later than the next time the associated part of the facility is replaced in the normal course of maintenance, or within five years, whichever comes first."

        A LEGISLATIVE COMMEMORATION, honoring Jesse Hastings, of Mount Vernon, South Dakota for quick actions that saved the life of his classmate.

    WHEREAS, on November 3, 2016, Jesse began a normal day in eighth grade when a classmate began choking; and

    WHEREAS, Jesse kept his cool and stepped in, performed the Heimlich Maneuver, and cleared his classmate's airway in less than one minute; and

    WHEREAS, Jesse's quick actions saved the life of his classmate, meeting one of Jesse's life goals:

    WHEREAS, the Reckord Trophy is presented to the most outstanding battalion in each area of the Army; and

    WHEREAS, the 153rd Engineer Battalion has an annual training record rating of excellent; and

        A LEGISLATIVE COMMEMORATION, Honoring the Jorgensen Land and Cattle Partnership of Tripp County as the 2015 Leopold Conservation Award recipient.

    WHEREAS, named for renowned conservationist Aldo Leopold, the Leopold Conservation Award recognizes farm and ranch families who demonstrate outstanding conservation leadership on their land and in their communities; and

    WHEREAS, the Jorgensens humbly began as a small family farm over 100 years ago and have grown to include livestock, a large variety of crops, and a hunting business, and the Jorgensen family owns and manages its fourth generation ranch with land health as a top priority; and

    WHEREAS, the Jorgensen Land and Cattle Partnership has been, and is currently, a leader in its area with the use of no till, crop rotation, and cover crops, especially in one of the state's fragile land areas. Over the past twenty-five years, the Jorgensens evolved their soil management practices to benefit the soil and crops, using soil monitoring tools, efficient nutrient application, and GPS tools; and

    WHEREAS, the family shares its experiences and expertise by working with South Dakota State University and assisting other farmers with soil management, including integrating livestock in crop management; and

    WHEREAS, a commitment to the health of South Dakota's natural resources is exemplified by the Jorgensen Land and Cattle Partnership as the recipient of the 2015 Leopold Conservation Award:

    NOW, THEREFORE, BE IT COMMEMORATED, by the Ninety-First Legislature of the State of South Dakota, that the Legislature recognizes the Jorgensen Land and Cattle Partnership for the honor of earning the 2015 Leopold Conservation Award in South Dakota.
