" Section 3. That subdivision (10) of § 26-8C-7 be amended to read:

(10) The court may only commit a child to the Department of Corrections if the judge finds that:

(a) No viable alternative exists;

(b) The Department of Corrections is the least restrictive alternative; and

(c) The child is currently adjudicated delinquent for an offense eligible for transfer proceedings pursuant to § 26-11-3.1; the child is currently adjudicated delinquent for a crime of violence pursuant to subdivision 22-1-2(9), sex offense pursuant to § 22-24B-1, felony sexual registry offense pursuant to chapter 22-24B, or burglary in the second degree pursuant to § 22-32-3; or the court finds from evidence presented at the dispositional hearing or from the pre-dispositional report that the youth presents a significant risk of physical harm to themselves or to another person.

COMMEMORATIONS

HC 1022 Introduced by: Representatives Peterson (Sue), Ahlers, and Pischke and Senator Langer

A LEGISLATIVE COMMEMORATION, Honoring and commending Abby Shay Neff of Sioux Falls, South Dakota, for receiving the President's Volunteer Service Award and local honors from the Prudential Spirit of Community Awards.

WHEREAS, the President's Volunteer Service Award recognizes students' understanding of social responsibility and action as important components of education and civil society; and

WHEREAS, Abby Shay Neff has volunteered over five hundred hours for the Washington Pavilion's many programs; and

WHEREAS, Abby Shay Neff has spent over two hundred hours providing art supplies to area nonprofit organizations and hospitals with her Recycled Rainbows community service project; and

WHEREAS, Abby Shay Neff created the #ColorChristmasBright Project that went into a local school and delivered over one thousand handmade crayons and one hundred sixty coloring books to underserved kindergarteners and first graders:

A LEGISLATIVE COMMEMORATION, Honoring Bria Shay Neff as the state winner of the "Doodle 4 Google" competition.

WHEREAS, Google is sponsoring a national competition selecting fifty-three winners from each state and territory to win a grand prize of a $30,000 scholarship and to have their doodle artwork featured on the Google website home page; and

WHEREAS, the competition inspires students to expresss their creativity, to explore the world around them, and to consider what the future could be like and how they can make an impact; and

WHEREAS, Bria Shay Neff, age ten, of Sioux Falls, South Dakota, was selected as the winner for South Dakota in the fourth grade to fifth grade age group, and her doodle artwork is entitled "Wild and Free" to symbolize all animals living in peace and raise awareness of endangered animals:

WHEREAS, Phyllis also served the South Dakota Legislature for one year as the documents clerk; and

WHEREAS, when not serving the State of South Dakota as the page advisor, Phyllis enjoys camping, traveling, and time with her family and friends:

NOW, THEREFORE, BE IT COMMEMORATED, by the Ninety-Second Legislature of the State of South Dakota, that Phyllis Perkovich be recognized for her five years of exceptional dedication to the legislative page program.
