NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

Department of Social Services: (April 6, 2000) intends to adopt rules relating to the Temporary Assistance for Needy Families (TANF) Program. The rules are being amended to update and clarify existing rules; require certain individuals to meet the mandatory work participation requirements; include additional households when determining the 60-month limit on receipt of TANF assistance; add cross-references; clarify that the parents' combined work hours are counted when determining deprivation due to unemployment; expand the list of income exempt from consideration; remove rules and provisions that no longer apply; amend provisions for excluding vehicles; exempt additional individuals from monthly reporting; establish the eligibility and participation requirements from the combined work and education activity (CWEA) adopted under HB 1056; amend criteria for approval of vocational training and transitional employment; expand the list of situations that require the department to provide adequate notice; and adopt the latest update to the federal poverty level. The general authority for these rules, as cited by the department, is SDCL 25-4-45.3, 28-1-61, 28-6-1, 28-6A-12, 28-7A-3, 28-7A-10, 28-7A-11, and HB 1056, Section 5.

A public hearing will be held on Tuesday, May 2, 2000, at 1:00 p.m., in Conference Rooms 1 and 2, Kneip Office Building, 700 Governors Drive, Pierre, South Dakota. Written comments must relate directly to the changes being proposed and must cite the specific rule number to which the comments are being directed. Material sent by mail must reach the department by May 12, 2000, to be considered. This hearing is being held in a physically accessible place. Department of Agriculture: (April 7, 2000) is proposing a rule which will authorize the Value Added Finance Authority to either increase or decrease the low or moderate net worth requirements for the Beginning Farmer Bond Program. The general authority for this rule, as cited by the department, is SDCL 1-16E-24.

A public hearing will be held on April 27, 2000, at 1:20 p.m., at the Holiday Inn, 1525 West Havens Street, Mitchell, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to Value Added Finance Authority, Foss Building, 523 East Capitol, Pierre, South Dakota 57501. Material sent by mail must reach the department by April 27, 2000, to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-5436 at least forty-eight hours before the hearing.

Secretary of State: (April 7, 2000) intends to adopt rules to clarify ballot instructions and colors, provide an additional guideline in verifying petitions, remove references to petition circulators being registered voters, provide additional information on statewide ballot question petitions, remove a reference to landowners in the petition to form a special district, and remove references to identifying marks on ballots. The general authority for these rules, as cited by the department, is SDCL 6-16-8, 12-1-9, 12-17B-7, 12-20-52, and 12-21-6.1.

A public hearing will be held on May 4, 2000, at 1:00 p.m. in the Governor's Large Conference Room, State Capitol, 500 East Capitol, Pierre, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to the Secretary of State, 500 East Capitol, Pierre, South Dakota 57501. Material sent by mail must reach the department by May 4, 2000, to be considered. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3537 at least forty-eight hours before the hearing.

The Department of Social Services has filed revisions to the current South Dakota Food Stamp Program Certification and Accountability Manual.

Rules Review Committee Meetings

The next meeting of the Interim Rules Review Committee will be held Wednesday, April 19, 2000, in Legislative Conference Rooms 1 and 2 of the State Capitol, Pierre, starting at 9:00 a.m. The committee chair has set the following tentative meeting schedule for the 2000 interim: June 7, July 11, August 16, September 12, October 18, November 14, and December 12. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
