NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

DEPARTMENT OF COMMERCE AND REGULATION: BOARD OF EXAMINERS OF PSYCHOLOGISTS: (April 12, 2001) intends to adopt a rule to change the minimum score on the written examination to the score set by the National Association. The general authority for this rule, as cited by the board, is SDCL 36-27A-22.

A public hearing will be held at the Governor's Inn, 700 West Sioux Avenue, Pierre, South Dakota, on June 28, 2001, at 1:00 p.m. CDT. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Board of Examiners of Psychologists, 135 East Illinois, Suite 214, Spearfish, South Dakota 57783. Written comments must be received by June 23, 2001, to be considered. Persons who have special needs for which the board can make arrangements may call (605) 642-1600 at least forty-eight hours before the hearing.

DEPARTMENT OF GAME, FISH AND PARKS: (April 13, 2001) is proposing rules to increase fees for resident Black Hills and Custer State Park bighorn sheep licenses; modify season dates for national wildlife refuge deer hunting seasons; increase the number and types of licenses available for the youth deer season in applicable new and existing units and establish, combine, and change boundaries and areas in the applicable hunting units; reduce the number and types of deer licenses available in the applicable special deer license areas and clarify season dates of the Black Hills deer season; in nonresident waterfowl licenses change certain terms, delete reference to Conservation Order in limiting the number of nonresident licenses which may be purchased, and provide and clarify the eligibility requirements for the purchase of additional nonresident licenses; in the tundra swan season establish a system for permitting residents to obtain subsequent permits under certain circumstances and increase the number of swan permits which may be available to nonresidents; in the special Canada goose and goose hunting seasons establish the number of permits and tags available in the applicable hunting units, change the hunting season dates in several applicable units, clarify that hunting of Canada geese in the applicable units is not permitted without a special permit and tag, and change license types in applicable units from two tag to three tag; revise the administration, system, use, and application of the preference certificate to the hunting of certain wildlife; change the required date for removal of tree stands on certain public land; establish a temporary fishing tournament boat license and its validity and establish the applicable fee. The general authority for these rules, as cited by the department, is SDCL 32-3A-4, 32-3A-11, 41-2-18, 41-6-10, 41-6-18.2, 41-6-18.4, 41-6-19.6, 41-6-21, 41-11-5, and 41-17-1.1.

A public hearing will be held at the Game Lodge in Custer State Park, on May 3, 2001, at 2:00 p.m. Copies of the proposed rules may be obtained from and written comments sent to John L. Cooper, Secretary, Foss Building, 523 East Capitol Avenue, Pierre, South Dakota 57501, and must be received prior to the hearing date. Comments may also be sent by e-mail to chuck.schlueter@state.sd.us. E-mail comments must include the commenter's name and address. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3387, before the hearing.

Rules Review Committee Meetings

The first meeting of the Interim Rules Review Committee will be Tuesday, April 17 in Room 413 of the State Capitol. The committee chair has set the following tentative meeting schedule for the 2001 interim: May 8, June 12, August 7, October 8, and November 28.

Agencies whose rules have had a public hearing will be scheduled to meet with the Rules Review Committee and are asked to have a representative present at the meeting to give background information on their rules.
