NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

Attorney General: Law Enforcement Officers Standards and Training Commission: (September 29, 2000) is considering rules to extend the training course from eight weeks to twelve weeks, increase the fee, and clarify the circumstances under which an applicant with a prior felony arrest will be allowed to be employed or certified as a law enforcement officer. The general authority for these rules, as cited by the commission is SDCL 23-3-35, 23-3-39.3, 23-3-39.4, 23-3-41, and 23-3-42.

A public hearing will be held on November 15, 2000, at 1:00 p.m., at the Ramkota Inn, Sioux Falls, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to the Law Enforcement Officers Standards and Training Commission, Division of Criminal Investigation, 500 East Capitol, Pierre, South Dakota 57501, and must be received by November 13, 2000, to be considered. Persons who have special needs for which the commission can make arrangements are asked to call (605) 773-4610, before the hearing.

Department of Health: (September 29, 2000) is considering rules to update regulations to conform to current health and safety standards in medical facilities, repeal rules permitting emergency supplies of controlled substances at unregistered sites, and repeal rules regarding alcohol and drug abuse treatment facilities. The general authority for these rules, as cited by the department is SDCL 34-1-17, 34-12-13, 34-12-29, 34-20A-2.1, 34-20A-27, 34-20B-41, and 34-22-9.

A public hearing will be held on October 30, 2000, at 9:00 a.m., in the large conference at the State Health Lab, 615 East Fourth Street, Pierre, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Department of Health, Attn: Joan Bachman, 615 East Fourth Street, Pierre, South Dakota 57501-1700, and must be received by November 9, 2000, to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3356, forty-eight hours before the hearing.

Rules Review Committee Meetings

The October 18th meeting of the Interim Rules Review Committee has been canceled. The committee will meet on Tuesday, November 14, 2000, in Room 413 of the State Capitol, Pierre, starting at 9:00 a.m. The committee chair has tentatively set the December meeting for the 12th. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
