NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Commerce and Regulation: South Dakota Cement Plant Commission: (October 22, 1999) is proposing rules to increase the pension benefit formula and the improvement factor, decrease vesting requirements for all active participants who retire after June 30, 1999, and improve the indexing of benefits for future inactive vested members. The general authority for these rules, as cited by the department, is SDCL 5-17-5 and 5-17-10.

A public hearing will be held in the Conference Room, South Dakota Cement Plant, 501 North Saint Onge Street, Rapid City, South Dakota, on Friday, November 19, 1999, at 10:00 a.m. to consider the adoption of the proposed rules. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Cement Plant Office, PO Box 360, Rapid City, South Dakota 57709, and must be received by November 19, 1999, to be considered. Persons who have special needs for which the department can make arrangements are asked to call (605) 394-5200, before the hearing.

Executive Appointments:

Colleen M. Waxler, Hot Springs, was reappointed on October 7, 1999, to the South Dakota Board of Counselor Examiners, effective immediately and to continue until July 1, 2001.

Richard B. Ostrander, Sioux Falls, was appointed on October 8, 1999, to the South Dakota Board of Counselor Examiners to replace Jean Lakner, effective immediately and to continue until July 1, 2000.

Geraldine C. Konenkamp, Rapid City, was appointed on October 8, 1999, to the South Dakota Board of Counselor Examiners, effective immediately and to continue until July 1, 2001.

Wayne M. Muth, Sioux Falls, was appointed on October 8, 1999, to the South Dakota State Board of Nursing Facility Administrators to replace Thomas V. Richter, effective immediately and to continue until July 1, 2002.

Gale N. Walker, Parkston, was appointed on October 8, 1999, to the South Dakota State Board of Nursing Facility Administrators to replace Dan Thayer, effective immediately and to continue until July 1, 2001.

Paul I. Engbrecht, Marion, was appointed on October 8, 1999, to the South Dakota State Board of Nursing Facility Administrators to replace Christian Thomas, effective immediately and to continue until July 1, 2002.

Rules Review Committee Meeting

The next meeting of the Interim Rules Review Committee will be held Tuesday, December 14, 1999, in Legislative Conference Rooms 1 and 2, Third Floor, State Capitol, Pierre, starting at 9:00 a.m. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.

Each agency is requested to provide LRC with eight copies of the most recent draft of its rules two days before the meeting.
