     On the printed bill, delete everything after the enacting clause and insert:

"      Section 1. That chapter 41-6 be amended by adding thereto a NEW SECTION to read as follows:

     The Department of Game, Fish and Parks shall provide for the issuance of a lifetime hunting and fishing license to any resident of South Dakota who meets the qualifications set forth in this Act. The lifetime hunting and fishing license allows the holder of the license the same rights and privileges as provided by a South Dakota resident fishing license and a South Dakota resident small game hunting license. No lifetime hunting and fishing license is valid after the calendar year during which it was issued unless the holder renews the license for the calendar year during which it will be used. The lifetime hunting and fishing license may not be used as proof of residency for other licenses issued by the department. If the holder of a lifetime hunting and fishing license is guilty of a hunting or fishing violation under this title, the holder is liable for a penalty not more than double the penalty that would otherwise apply to the violation. Any person is eligible to receive a lifetime hunting and fishing license if:

             (1)    The person is at least eighteen years of age;
             (2)    The person is a South Dakota resident; and
             (3)    The person was issued a South Dakota resident fishing license, a South Dakota resident small game hunting license, or a combination of these during the previous calendar year.

     Section 2. That chapter 41-6 be amended by adding thereto a NEW SECTION to read as follows:

     The lifetime hunting and fishing license may be issued or renewed directly by the Department of Game, Fish and Parks, including issuance or renewal of the license via electronic means, or by a license agent. No fee may be charged by the department for the renewal of a license. However, if the license is renewed by a license agent, the agent may charge a renewal fee not to exceed two dollars. Fees for the issuance of a lifetime hunting and fishing license are based on the age of the applicant at the time of issuance as follows:

             (1)    Eighteen to twenty-four years of age, inclusive: one thousand dollars;
             (2)    Twenty-five to twenty-nine years of age, inclusive: nine hundred dollars;
             (3)    Thirty to thirty-nine years of age, inclusive: eight hundred dollars;
             (4)    Forty to forty-nine years of age, inclusive: seven hundred dollars;
             (5)    Fifty to fifty-nine years of age, inclusive: six hundred dollars;
             (6)    Sixty to sixty-five years of age, inclusive: five hundred dollars;
             (7)    Sixty-six to sixty-nine years of age, inclusive: four hundred dollars;
             (8)    Seventy years of age and older: two hundred dollars.

     Of the money generated by the fee for the issuance of each lifetime hunting and fishing license, an amount equal to the combined cost of a South Dakota resident small game hunting license and a South Dakota resident fishing license for the year in which the lifetime license is issued shall be deposited in the Department of Game, Fish and Parks fund. The remainder shall be deposited in the South Dakota wildlife enhancement fund established pursuant to section 3 of this Act.

     Section 3. That chapter 41-6 be amended by adding thereto a NEW SECTION to read as follows:

     The South Dakota wildlife enhancement fund is hereby established as a special fund in the State treasury. Money in the fund may only be used for the promotion and enhancement of wildlife and for the provision of hunting opportunities and hunting access for the public. The fund consists of money generated by the fees established pursuant to section 2 of this Act and money from all legal public and private sources, including legislative appropriations and federal grants. Any interest earned on money in the fund shall be deposited in the Department of Game, Fish and Parks fund. Money may be expended from the South Dakota wildlife enhancement fund as determined in the general appropriations act according to Title 4.

     Section 4. That chapter 41-6 be amended by adding thereto a NEW SECTION to read as follows:

     The Game, Fish and Parks Commission shall promulgate rules pursuant to chapter 1-26 pertaining to lifetime hunting and fishing licenses as provided in this section. The rules shall specify license application and renewal procedures and requirements, requirements governing the use of the licenses, procedures for the collection of fees, and procedures and criteria for the suspension or revocation of licenses."
