On page 5, after line 12 of the printed bill, insert:

" Section 9. That the code be amended by adding a NEW SECTION to read:

A facility is not civilly or criminally liable for the inadvertent or intentional disclosure of a recording by a resident or a person who consents on behalf of the resident for any purpose not authorized by this Act.

A facility is not civilly or criminally liable for a violation of a resident's right to privacy arising out of any electronic monitoring conducted pursuant to this Act.".
