___________________ moved that SB 96 be amended as follows:

     On page 1 of the House engrossed bill, delete lines 6 to 10 , inclusive, and insert:

"

     Any second or third class municipality holding a license pursuant to Title 35 may serve or provide for the service of food, prepared food, and beverages at any establishment operating under such license. Any first class municipality holding a license pursuant to Title 35 which is serving or providing for the service of food, prepared food, and beverages at an establishment operating under such license as of July 1, 2004, may continue to serve or provide for the service of food, prepared food, and beverages at such establishment.

     Section 2. That chapter 35-4 be amended by adding thereto a NEW SECTION to read as follows:

     Any municipality may serve or provide for the service of food, prepared food, and beverages at any publicly owned airport, convention center, recreational facility, or golf course.".
