        FOR AN ACT ENTITLED, An Act to make accessible to the public certain information relating to the partners in education tax credit program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That chapter 13-65 be amended by adding a NEW SECTION to read:
    Upon request, the division shall make accessible to the public any information provided to the division pursuant to subdivision 13-65-4(1), (2), (8), (10), (11), or § 13-65-8.
    Section 2. That chapter 13-65 be amended by adding a NEW SECTION to read:
    Upon request, any scholarship granting organization shall make accessible to the public any information provided pursuant to subdivisions 13-65-4(4) to (7), inclusive.
    Section 3. That chapter 13-65 be amended by adding a NEW SECTION to read:
    Upon request, the auditor general shall make accessible to the public any information provided to the auditor general pursuant to § 13-65-5.
    Section 4. That § 13-65-9 be amended to read:
    13-65-9. The division shall provide a standardized format for the scholarship granting

organization to report the information in subdivision 13-65-4(10). Any information provided relating to the identity of a taxpayer that provides an eligible contribution pursuant to this chapter shall remain confidential unless the company deems otherwise Notwithstanding the provisions of § 58-4-50 to 58-4-54, inclusive, any scholarship information reported to the division pursuant to subdivision 13-65-4(10) is a public record as defined in § 1-27-1.1.
