24:28:09:01. Permit for assignment required. A person employed in the following areas is required to hold a valid educator permit for the position to which the person is assigned:
(1) K-12 Native American Lakota, Dakota, Nakota language and culture expert;
(2) K-12 eminent scholar Lakota, Dakota, Nakota language and culture expert;
(3) Performing artist;
(4) Expert lecturer;
(5) International teacher;
(6) Drivers education instructor;

24:28:09:02. Permit restrictions. A teacher, administrator, or education specialist certificate or endorsement is restricted from being added to the permit unless the individual has completed the required preparation or alternative certification program.

24:28:09:03. Application process for an educator permit. An applicant for an educator permit shall submit:
(1) A completed application;
(2) Any application fee as provided in chapter 24:28:05;
(3) Documentation that the requirements of the requested permit are met;
(4) Additional documentation upon request; and
(5) Recommendation from the appropriate agency, if required, that the applicant meets the requirements of the permit.

24:28:09:05. Native American Lakota, Dakota, Nakota language and culture permit. The Native American Lakota, Dakota, Nakota language and culture permit is a five-year renewable permit awarded to a non-educator entering the education profession to teach Lakota, Dakota, or Nakota languages and culture in grades K-12. The Native American Lakota, Dakota, Nakota language and culture permit is limited to the areas of Native American language and culture.

24:28:09:06. Native American Lakota, Dakota, Nakota language and culture permit eligibility requirements. A Native American Lakota, Dakota, Nakota language and culture permit is issued to an applicant who:
(1) Demonstrates proficiency in Lakota, Dakota, or Nakota oral and written language and culture with recognition from a regionally-accredited institution of higher education offering a teacher education program in Lakota studies or an organization approved by both a tribal government in South Dakota and the department;
(2) Completes a three-semester-hour methodology course directly related to teaching Lakota, Dakota, Nakota language from a regionally-accredited institution of higher education; and
(3) Is recommended for licensure to teach Lakota, Dakota, or Nakota oral and written language and culture to grades kindergarten through 12 by a regionally-accredited institution of higher education offering a teacher education program in Lakota studies or an organization approved by a tribal government in South Dakota and the department.

24:28:09:08. Eminent scholar Lakota, Dakota, Nakota language and culture permit eligibility requirements. The eminent scholar Lakota, Dakota, Nakota language and culture permit is issued to an applicant who:
(1) Completes a three-semester-hour methodology course directly related to teaching Lakota, Dakota, Nakota language and culture at a regionally-accredited institution of higher education;
(2) Meets the requirements of the eminent scholar program recognized by an approved indigenous language board or similar organization created and recognized by a tribal government; and
(3) Is recommended for licensure to teach Lakota, Dakota, or Nakota oral and written language and culture in grades kindergarten through 12 by an indigenous language board or similar organization created and recognized by a tribal government.

24:28:09:09. Performing artist permit. The performing artist permit is a one-year renewable permit awarded to an individual who is qualified to teach in the areas of art, dance, drama, and music.

24:28:09:10. Performing artist permit eligibility requirements. A performing artist permit is issued to an applicant who:
(1) Holds a minimum of a high school diploma or its equivalent;
(2) Has a minimum of five years of occupational experience in the performing arts areas listed in § 24:28:09:09 in which the permit is requested; and
(3) Submits an intent to employ form from the employing public or department-accredited school pursuant to § 24:28:09:11.

24:28:09:11. Performing artist permit employer requirements. If an offer of employment is accepted by someone who is qualified to teach pursuant to § 24:28:09:09 but is not a certified educator, the employing school district or department-accredited school must state on the intent to employ form provided to the applicant for submission with their application:
(1) That the school is unable to hire a certified educator to fill the vacancy;
(2) The position to be held by the applicant; and
(3) The name of the certified teacher who will serve as a mentor to the applicant.

24:28:09:12. Junior reserve officers' training corps permit. A junior reserve officers' training corps (JROTC) permit is a five-year renewable permit issued to an active or retired military person to serve as a JROTC teacher.

24:28:09:14. Expert lecturer permit. An expert lecturer permit is a five-year renewable permit issued to an individual with distinctive qualifications and a unique capacity to enhance educational programs in schools. The expert lecturer permit is limited to the area of the expert’s specialty.

(2) Demonstrates a unique qualification and experience that enhances school programs.

24:28:09:16. Expert lecturer permit employer requirements. The employing public or department-accredited school must meet the following requirements in order for the applicant to receive the permit:
(1) Recommend the applicant for employment;
(2) Develop a program to assist the lecturer with academic and classroom support;
(3) Provide a mentor teacher to the applicant; and
(4) Provide assurances of regular observation, guidance, and evaluation of the performance of assigned duties.

24:28:09:22. Drivers education permit eligibility requirements. A drivers education permit is issued to an applicant who completes eight semester hours of coursework in the areas of: basic driver education methodology for classroom and behind-the-wheel instruction; advanced driver education curriculum materials, development, and improvement; and general traffic safety covering schools, pedestrians, passengers, bicycles, school buses, and all other motorized vehicles.

24:28:09:23. Drivers education permit eligibility requirements. A drivers education instructor shall meet the following eligibility requirements in addition to those in § 24:28:09:22:
(1) Be at least 21 years of age;
(2) Possess a valid Class-1 South Dakota driver license or an equivalent driver license from another state;
(3) Have a high school diploma or its equivalent;
(4) Have no traffic-related driver license court suspensions or revocations within the preceding 36 months;
(5) Have no convictions for traffic violations that carry a mandatory suspension or revocation of the driver license within the preceding 36 months;
(6) Have no convictions for traffic violations causing a fatal traffic collision; and
(7) Have no convictions for driving with a revoked or suspended license or driving under the influence of alcohol or a controlled substance within the past five years.

24:28:09:25. American Sign Language permit eligibility requirements. The American Sign Language permit is issued to an applicant who:
(1) Receives a score of intermediate or Level 3 or higher on the Sign-Language Proficiency Instrument (SLPI), or receives certification from the American Sign-Language Teachers Association (ASLTA); and
(2) Completes six semester hours of coursework including understanding deaf cultures and understanding American Sign Language grammar.

24:28:09:26. Braille education permit. A Braille education permit is a five-year renewable permit issued to an individual to serve as an instructor for blind or visually-impaired students in public or Department-accredited schools.

(1) Passes the state-designated content test; and
(2) Completes six semester hours of coursework including: introduction to teaching students who are blind; methodology of teaching elementary reading; and introduction to classroom modifications and assistive technology for students who are blind.

24:28:09:34. School business official permit eligibility requirements. The school business official permit is issued to an applicant who:
(1) Has a bachelor’s degree or higher from a regionally-accredited institution of higher education; and
(2) Has two years of experience as a school business official in a public or department-accredited school or a minimum of two semester hours in each of the following areas of undergraduate or graduate level coursework including: accounting, school finance, school law, and school business administration.

24:28:09:35. CEO permit. The CEO permit is a five-year renewable permit issued in the field of educational leadership to an individual from outside the traditional educational route. A CEO serves in the leadership role for the public or department-accredited school or district in absence of a certified school superintendent or K-12 principal.

24:28:09:38.01. Length of CTE instructor permit. The initial CTE instructor permit is a three-year permit that can be renewed upon completion of subdivision 24:28:09:39(3). A subsequent permit is a five-year renewable permit.

24:28:09:39. CTE instructor permit eligibility requirements. The career and technical education (CTE) instructor permit may be issued to an applicant who:
(1) Holds a minimum of a high school diploma or its equivalent;
(2) Has one of the following:
(a) An associate of applied science degree or higher in a related CTE field;
(b) Four thousand hours of validated work experience in a related CTE field earned within the previous five calendar years; or
(c) Holds a national certification in a related CTE field; and
(3) Submits an official transcript from a regionally-accredited institution of higher education showing the completion of a mentorship experience worth at least four credits and a course in methods of CTE worth at least two credits, both with a grade of C or higher, within the first three years of employment.

(1) Provide a mentor teacher to the applicant;
(2) Develop a program to assist the CTE instructor with academic and classroom support;
(3) Provide assurances of regular observation, guidance, and evaluation of the performance of assigned duties; and
(4) Recommend the CTE instructor based on documented performance and progress.

24:28:09:45. Student teacher permit. The student teacher permit is issued to an individual who is under the direct supervision of an assigned cooperating teacher. The student teacher permit is limited to an individual who has:
(1) Met the requirements of the regionally accredited institution of higher education offering the educator preparation program where the individual is enrolled;
(2) Obtained sign-off from the institution; and
(3) Submitted an official transcript that indicates the individual will likely satisfactorily complete the educational coursework by the start date of the student teaching experience.

24:28:09:47. Student teacher permit--Regionally accredited institute of higher learning requirements. The regionally accredited institution of higher education offering the educator preparation program attended by the student teacher shall:
(1) Ensure the student teacher candidate has the documented performance and progress to qualify for the student teaching experience under the direct supervision of an assigned cooperating teacher; and
(2) Provide sign-off on the student teacher's assignment, with acknowledgement that the student teacher candidate has successfully completed the coursework expected of the student teacher candidate to qualify for the student teaching experience at the time of application.

24:28:09:48. Advanced student teacher permit. The advanced student teacher permit is issued to an individual who does not require direct supervision by an assigned cooperating teacher. A school partner or department-accredited school may employ an individual who has been issued an advanced student teacher permit as a teacher of record during the individual's student teaching experience, the successful completion of which must satisfy the associated criteria for the student teaching experience. The advanced student teacher permit may only be issued to an individual who has:
(1) Received a passing score on:
(a) The state-designated pedagogy test; and
(b) The state-designated content test or tests required to teach in the content area or areas assigned;
(2) Obtained sign-off from the regionally accredited institution of higher education offering the educator preparation program where the individual is enrolled;
(3) Submitted an official transcript that indicates that the individual is registered for any final coursework necessary to complete the educator preparation program and will likely satisfactorily complete the educational coursework by the start of the student teaching experience;
(4) Agreed to participate in a mentor program; and
(5) Agreed to adhere to the South Dakota Code of Professional Ethics for Teachers as set forth in chapter 24:08:03.

24:28:09:49. Advanced student teacher permit--Employer requirements. The employing school partner or department-accredited school shall:
(1) Verify the applicant has a valid advanced student teacher permit;
(2) Document that the school attempted but was unable to hire a teacher with a professional or advanced teaching certificate prior to hiring an applicant with an advanced student teaching permit;
(3) Complete an intent to employ for an individual holding an advanced student teacher permit;
(4) Provide board minutes indicating the approval of hiring a student teacher holding an advanced student teacher permit to serve as the teacher of record;
(5) Provide an assigned cooperating teacher for the candidate to assist with academic and classroom management support through regular meetings:
(6) Provide assurances of regular observation, guidance, and evaluation of assigned duries by the building principal;
(7) Report the approved student teacher in the Personnel Record Form;
(8) Provide monetary compensation to the student teacher, if the individial is serving as a teacher of record;
(9) Offer enrollment in a mentor program in addition to the assigned cooperating teacher; and
(10) Provide the applicant with information about the South Dakota Code of Professional Ethics for Teachers, as set forth in chapter 24:08:03.

(3) A minimum level of proficiency of a 3.0 grade point average for content and pedagogy coursework;
(4) Successful completion of coursework expected of the student teacher candidate to qualify for student teaching experience at the time of application; and
(5) Registration for the final coursework necessary for program completion, with the coursework reflected on an official transcript.

If an offer of employment is accepted by someone who is qualified to teach pursuant to § 24:28:09:53 but is not a certified educator, the employing school district or department-accredited school must state on the intent to employ form provided to the applicant for submission with their application:
(1) That the school is unable to hire a certified educator to fill the vacancy;
(2) The position to be held by the applicant; and
(3) The name of the certified teacher who will act as a mentor to the applicant.
