FOR AN ACT ENTITLED, An Act to
prohibit discrimination against health care providers by
health insurers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 58-18 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 58-18 be amended by adding thereto a NEW SECTION to read as follows:
No health benefit plan as defined by
§
58-18-42 nor any other entity which pays or
reimburses health benefits may discriminate in the amount paid or reimbursed based upon the
type of licensure of the provider. If two or more providers are authorized by their scope of
practice acts to provide the same or similar health care, the amount to be paid or reimbursed for
such service shall be identical.
