FOR AN ACT ENTITLED, An Act to
clarify the responsibilities of foster parents in regard to
foster children.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 25-5 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 25-5 be amended by adding thereto a NEW SECTION to read as follows:
No foster parent is liable for the acts of his or her foster child. However, this section does
not apply to any action based on agency or negligent entrustment of a motor vehicle. No costs
or fees may be charged or assessed against a foster parent as a result of a foster child in their care
being adjudicated under
§
26-8B-6 or 26-8C-7.
