An Act to provide for an organ donor designation on fishing and hunting licenses.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That a NEW SECTION be added:
34-26-21.2. Licenses--Fishing and hunting--Information regarding organ donation.
The Department of Game, Fish and Parks shall provide each person applying for a fishing or hunting license an opportunity to review information about organ donation. The department may make this information available:
(1) On the Department of Game, Fish and Parks website;
(2) Through mailings;
(3) On posters and brochures;
(4) In manuals published after July 1, 2021; and
(5) By any other means the department deems appropriate.
Section 2. That a NEW SECTION be added:
34-26-52.2. Licenses--Fishing and hunting--Designation as organ donor.
If requested by an applicant for a fishing or a hunting license, the Department of Game, Fish and Parks shall place on a license issued to the person a designation indicating that the license holder is an organ donor. The department shall create a computer record of organ donors designated in accordance with this section and shall forward the record to the Department of Public Safety for retention and maintenance in accordance with § 34-26-52.
