An Act to authorize members of the Legislature to submit a request for continuing education to a licensing board or commission in this state.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added:

2-4-2.4. Continuing education.

A member of the Legislature currently licensed by a professional or occupational board or commission in this state may be eligible to receive credit for continuing education required by the member's respective licensing board or commission where the board or commission authorizes an application for continuing education credit for licensees generally. The member shall submit a request in writing to the respective licensing board or commission that includes:

1) The amount of continuing education sought;

2) A detailed explanation of how the member's service relates to the required continuing education; and

3) The category of continuing education the credit would count toward, if applicable.

The licensing board or commission has sole authority to determine if the member's request for continuing education credit is granted in full, part, or rejected. The respective board or commission may set a limit on the amount of continuing education a member may earn by service in the Legislature.
