An Act to prohibit the isomerization and acetylation of cannabinoids and the sale and possession of products created by the isomerization and acetylation of cannabinoids and to provide a penalty therefor.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That chapter 34-20B be amended with a NEW SECTION:
No person may:
(1) Engage in the isomerization of cannabinoids to create isomers of tetrahydrocannabinol, cannabidiol, or any other known or unknown cannabinoid;
(2) Engage in the acetylation of cannabinoids;
(3) Sell any material, compound, mixture, or preparation that was created using the isomerization of cannabinoids to create isomers of tetrahydrocannabinol, cannabidiol, or any other known or unknown cannabinoid; or
(4) Sell any material, compound, mixture, or preparation that was created by applying the acetylation process to cannabinoids.
A violation of this section is a Class 4 felony.
Section 2. That chapter 34-20B be amended with a NEW SECTION:
No person may knowingly possess any material, compound, mixture, or preparation that was created using the isomerization of cannabinoids to create isomers of tetrahydrocannabinol, cannabidiol, or any other known or unknown cannabinoid. No person may knowingly possess any material, compound, mixture, or preparation that was created by applying the acetylation process to cannabinoids. A violation of this section is a Class 5 felony.
