An Act to establish employees' exemptions from employer-imposed COVID-19 vaccine requirements.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That chapter 60-2 be amended with a NEW SECTION:
No employee in this state may be required by an employer to receive a COVID-19 vaccination if the employee submits to the employer:
(1) A written statement from a physician stating that the COVID-19 vaccination is contraindicated for medical reasons;
(2) A signed statement from the person in which the person dissents and objects to receiving a COVID-19 vaccine on religious grounds, which includes moral, ethical, and philosophical beliefs or principles; or
(3) A signed statement from the person attesting to the person's immunity by prior COVID-19 infection.
This section does not apply to service members of the South Dakota National Guard, who are subject to federal activation pursuant to Title 10 of the United States Code.
