An Act to authorize the participation of adopted children in the medical assistance program.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 28-6 be amended with a NEW SECTION:

Any child adopted in accordance with chapter 25-6 is eligible to participate in the medical assistance program as set forth in this chapter until the child reaches age twenty-one.

The Department of Social Services shall, in rules promulgated under chapter 1-26, establish:

(1) The time and manner of application for benefits under this section;

(2) The methods by which the child's participation is to be administered;

(3) Safeguards against the disclosure or improper use of information regarding the medical needs of the child; and

(4) Any other requirements that may be necessary to administer this section.
