An Act to provide immunity for off-duty law enforcement officers who perform a citizen's arrest or assist with a lawful arrest.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added to chapter 23A-3:

Any law enforcement officer, as defined in § 23-3-27, who performs a citizen's arrest, pursuant to § 23A-3-3, or otherwise assists in a lawful arrest under chapter 23A-3, while the officer is off duty, is immune from criminal prosecution and from civil liability for the arrest.
