class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0"> Terms used in this chapter shall mean:</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (1)  "Commissioner," the commissioner of </span><span class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">the Bureau of Human Resources and A</span><span class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">dministration;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (2)  "Emergency Vehicle," vehicles of the fire department, police vehicles, and ambulance and emergency vehicles of the state, county, or city or public service corporations;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (3)  "Intersection," the area embraced within the prolongation of the lateral curb lines or, if none, then the lateral boundary lines of two or more city streets or capitol complex driveways which join one another at an angle whether or not one such street or driveway crosses another;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (4)  "Capitol complex," the lands owned by the state within the city of Pierre, South Dakota, which are not dedicated to the public for public streets or alleys;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (5)  "Vehicle," any device in, upon, or by which any person or property is or may be transported or drawn on a public highway;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (6)  "Official traffic signs," all signs and markings, other than signals, not inconsistent with these rules, placed or erected by the state or officials having jurisdiction for the purpose of guiding, directing, warning, or regulating traffic;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (7)  "Parking," the standing of a vehicle, whether attended or unattended, upon a driveway or parking area;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (8)  "Public officers" or "capitol police," the persons appointed pursuant to SDCL </span><a href="https://sdlegislature.gov/Statutes?Statute=23-3-2"><span class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0-000003">23-3-2</span></a><span class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (9)  "Driveway," any driveway in the capitol complex;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (10)  "Parking area," any designated area in the capitol complex which provides parking for a vehicle;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (11)  "Street" or "avenue," any street or avenue in the city of Pierre, South Dakota that is dedicated to the public use;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (12)  "Traffic," any movement of a vehicle while using any driveway or parking area;</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000C0">    (13)  "Careless driving," controlling a vehicle carelessly and without due caution at a speed or in a manner so as to endanger any person or property.</span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve" class="sec2af339-76a2-41b1-92d9-c82b2b50b000000002"> </span></p><p dir="ltr" class="sec2af339-76a2-41b1-92d9-c82b2b50b000P0"><span xml:space="preserve"
