(2) "Client"\r\nmeans an individual admitted to an appropriate regional facility pursuant to\r\nSDCL 27A-10-2 or 27A-10-3;

\r\n\r\n

(3) "Department"\r\nmeans the Department of Social Services; and

\r\n\r\n

(4) "Facility"\r\nmeans an entity capable of providing crisis stabilization, including overnight\r\nresidential services 24 hours a day, 7 days a week to stabilize acute\r\npsychiatric or behavioral symptoms, evaluate treatment needs, and develop plans\r\nto meet the needs of the person served on a short-term basis.

67:63:02:01. Application\r\nfor designation as an appropriate regional facility. A facility\r\nseeking to operate as an appropriate regional facility shall submit an\r\napplication requesting designation to the department. The application must\r\ninclude a description of how the facility meets the requirements of SDCL 27A-10-1.2.

\r\n\r\n

Any\r\nfacility designated as an appropriate regional facility shall allow the\r\ndepartment unrestricted access to the facility, including access to clients,\r\npersonnel, and client and facility records, to monitor compliance with this\r\narticle and SDCL 27A-10-1.2.

The\r\ndepartment shall make application forms available upon request.

67:63:02:02. Denial\r\nof designation.\r\nThe department shall provide to each applicant written notice approving or\r\ndenying the designation. If the application is denied, the notice must include\r\nthe reasons for the denial. An applicant may reapply after addressing the\r\nreasons for the denial of the designation.

67:63:02:05. Reasons\r\nfor placing a facility on probation. The department may place the facility on\r\nprobation if:

\r\n\r\n

(1) The facility\r\nviolates the provisions of this article or SDCL 27A-10-1.2;

\r\n\r\n

(2) The facility\r\nfalsifies information provided to the department for designation status or\r\nfunding purposes;

\r\n\r\n

(3) The facility\r\nparticipates in, condones, or permits an illegal act;

\r\n\r\n

(4) The facility is\r\nassociated with fraud, deceit, or coercion;

\r\n\r\n

(5) The facility fails\r\nto comply with state and federal licensing requirements or other standards\r\napplicable to the facility;

\r\n\r\n

(6) The facility\r\nrefuses to allow the department access for a compliance review or other\r\nnecessary follow-up review related to designation.

67:63:02:06. Probation\r\nprocedures.\r\nIf the department determines that there is cause to place a facility on\r\nprobation, the department shall send the facility written notice of\r\nprobationary status and areas of noncompliance. The facility shall, within 30\r\ndays of receiving the notice, develop and submit a plan of correction.

\r\n\r\n

Within\r\nfive business days of receiving the plan of correction, the department shall\r\nnotify the facility of the department's decision to approve the plan of\r\ncorrection.

\r\n\r\n

The\r\ndepartment may conduct a site visit at least once during the probationary\r\nperiod to monitor progress on plan of correction items. At the end of the\r\nprobationary period, the department shall conduct a review of the facility and\r\nmay remove the probationary status of the facility or revoke the facility's designation.

67:63:02:08. Revocation\r\nprocedures.\r\nThe department shall provide a facility with a 15 calendar day written notice\r\nof the department's intent to revoke the facility's designation. The 15\r\ncalendar day written notice is not required if the revocation is necessary to\r\nprevent danger to the life, health, or safety of a client. The notice shall\r\ncontain the reasons for the revocation and a process by which a facility may\r\nrequest a fair hearing.

The request must be sent by certified mail within 15\r\ncalendar days of receipt of the notification of the department's action. A fair\r\nhearing is conducted under the provisions of chapter 67:17:02 and SDCL chapter 1-26.

The hearing\r\nofficer shall set a time and place for the hearing at the earliest reasonable\r\ntime. The hearing officer may continue the hearing at the request of any party\r\ninvolved and upon agreement by the parties to a specific extension of time.

67:63:03:05. Sentinel\r\nevent notification.\r\nEach appropriate regional facility shall, within 24 hours, report to the\r\ndepartment any sentinel event, including the death of a client, if that death\r\nis not primarily related to the natural course of the client's illness or an\r\nunderlying condition, permanent harm to a client, severe temporary harm to a\r\nclient, and any intervention required to sustain a client's life.

\r\n\r\n

The\r\nfacility shall submit a follow-up report to the department within 72 hours of\r\nany sentinel event. The report must include:

\r\n\r\n

(1) A written\r\ndescription of the event;

\r\n\r\n

(2) The client's name\r\nand date of birth; and

\r\n\r\n

(3) A description of\r\nthe immediate actions taken by the facility.

\r\n\r\n

Each\r\nfacility shall develop root cause analysis policies and procedures to utilize\r\nin response to significant events.

\r\n\r\n

Each facility\r\nshall, as soon as possible, report to the department any fire that results in\r\nstructural damage or that results in injury or death; any partial or complete\r\nevacuation of the facility that results from a natural disaster; any loss of\r\nservices for more than 24 hours, such as electricity, natural gas, and\r\ntelephone; and any nonfunctioning equipment for more than 24 hours such as an\r\nemergency generator, fire alarm system, sprinklers, or other critical equipment\r\nnecessary for the operation of the facility.

67:63:04:02. Life\r\nsafety codes.\r\nFor each setting in which an appropriate regional facility provides services,\r\nthe facility shall comply with the applicable life safety codes described in § 67:62:09:02.

\r\n\r\n

An\r\nautomatic sprinkler system is not required in an existing facility unless\r\nsignificant renovations occur or remodeling occurs. An existing automatic\r\nsprinkler system must remain in service.

\r\n\r\n

New construction,\r\nrenovations, additions, and changes of space must comply with the applicable\r\nlife safety codes described in § 67:62:09:02. Each facility shall also\r\ncomply with the building construction standards described in § 67:62:09:02.
