In addition, terms used in this chapter and SDCL chapter 49-31 mean:</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (1)&nbsp;&nbsp;&quot;Access charges,&quot; the amount one local exchange telecommunications company charges an interexchange carrier for use of telecommunications facilities to originate or terminate calls within its service area;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (2)&nbsp;&nbsp;&quot;Alternative operator service provider (AOS),&quot; a corporation, company, partnership, person, or any entity, other than the serving local exchange or interexchange carrier, providing a connection by contract to intrastate or interstate long distance or to local services from such places as hotels, motels, hospitals, campuses, and customer-owned pay telephones;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (3)&nbsp;&nbsp;&quot;Call blocking,&quot; denying the completion of a call which would allow the caller to reach a long distance telephone company from an AOS company;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (4)&nbsp;&nbsp;&quot;Customer,&quot; an individual, partnership, association, joint-stock company, trust, corporation, governmental entity, or any other entity which subscribes to telecommunications services, including interexchange carriers and end users;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (5)&nbsp;&nbsp;&quot;Deregulation,&quot; partial or total exemption from regulation by the commission of a service, rate, product, or practice;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (6)&nbsp;&nbsp;&quot;End user,&quot; a person or entity, except a telecommunications company, which utilizes telecommunications services for its own use;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (7)&nbsp;&nbsp;&quot;Extended area service (EAS),&quot; a telecommunications service that expands a local calling area to include another local exchange area;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (8)&nbsp;&nbsp;&quot;Interexchange carrier,&quot; a telecommunications company which renders telecommunications service between points which are not in the same local calling area established in the tariff of a local exchange carrier;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (9)&nbsp;&nbsp;&quot;Interstate access,&quot; the ability of interexchange carriers to utilize the facilities of a local exchange carrier for the origination and termination of interexchange interstate interLATA calls;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (10)&nbsp;&nbsp;&quot;Intrastate access,&quot; the ability of a telecommunications company to utilize the facilities of the local exchange carrier for the origination and termination of intrastate interexchange calls;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (11)&nbsp;&nbsp;&quot;Intrastate telecommunications services,&quot; telecommunications services that are functionally intrastate, with points of origination and termination within South Dakota, regardless of the specific routing of the affected traffic;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (12)&nbsp;&nbsp;&quot;Local calling area,&quot; a geographical area, including extended area service (EAS) points as defined in the telephone company's local exchange service tariff, in which an end user may complete a call without incurring long distance charges;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (13)&nbsp;&nbsp;&quot;Resale,&quot; the subscription to local or long distance telecommunications services and facilities by an entity which then offers them for sale to others with or without enhancements;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (14)&nbsp;&nbsp;&quot;Reseller,&quot; a person or entity reselling local or long distance telecommunications services.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <b>Source:</b> 16 SDR 106, effective December 27, 1989; 25 SDR 89, effective December 27, 1998.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <b>General Authority:</b> SDCL <A HREF="/statutes/DisplayStatute.aspx?Type=Statute&Statute=49-31-3">49-31-3</A>, <A HREF="/statutes/DisplayStatute.aspx?Type=Statute&Statute=49-31-5">49-31-5(10)(11)(12)(14).</A></p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <b>Law Implemented:</b> SDCL <A HREF="/statutes/DisplayStatute.aspx?Type=Statute&Statute=49-31-3">49-31-3</A>, <A HREF="/statutes/DisplayStatute.aspx?Type=Statute&Statute=49-31-5">49-31-5.</A></p> </div> </body> </html>
