class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">The term "collaborative agreement," as used in this chapter, means a contract that:</span></p><p dir="ltr" class="safad4da906a6468791a4f77759ef93ceStatuteNumber1"><span xml:space="preserve" class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">(1)    Is signed by a physician assistant, who has not filed an affidavit with the board attesting to the completion of at least six thousand practice hours, and a physician licensed in accordance with chapter </span><a href="https://sdlegislature.gov/Statutes?Statute=36-4" rel="noopener"><span class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">36-4</span></a><span class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">; and</span></p><p dir="ltr" class="safad4da906a6468791a4f77759ef93ceStatuteNumber1"><span class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">(2)    Contains the terms and conditions governing the collaboration of the providers.</span></p><p dir="ltr" class="safad4da906a6468791a4f77759ef93ceStatute"><span class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">A physician who is entering into a collaborative agreement must be free from any disciplinary action that would restrict the ability to collaborate.</span></p><p dir="ltr" class="safad4da906a6468791a4f77759ef93ceStatute"><span class="safad4da906a6468791a4f77759ef93ceDefaultParagraphFont">A physician assistant, for whom a collaborative agreement has been signed, shall keep a copy of the agreement on file at the physician assistant's primary practice site. The term of office for each member is three years. No member may be appointed to more than three consecutive, full terms. If a vacancy occurs, the board must appoint a new member to fill the unexpired term. The appointment of a member to an unexpired term is not considered a full term.</span></p><p dir="ltr" class="s371dfa9877cd40d5b5995a51b2ec1850Statute"><span xml:space="preserve" class="s371dfa9877cd40d5b5995a51b2ec1850DefaultParagraphFont">The council shall meet at least twice each year, at a time and place set by the council, and may hold additional meetings as necessary to conduct business. and</span></p><p dir="ltr" class="se2739c5cabac4f228aaabc52a2358392StatuteNumber1"><span class="se2739c5cabac4f228aaabc52a2358392DefaultParagraphFont">(5)    Has:</span></p><p dir="ltr" class="se2739c5cabac4f228aaabc52a2358392StatuteNumber2"><span class="se2739c5cabac4f228aaabc52a2358392DefaultParagraphFont">(a)    Filed an affidavit with the board attesting to the completion of at least six thousand practice hours; Upon completion of the criminal background check, the Division of Criminal Investigation shall forward to the board all information obtained as a result of the criminal background check. This information shall be obtained prior to permanent licensure of the applicant. The board may require a state and federal criminal background check for any licensee who is the subject of a disciplinary investigation by the board. Failure to submit or cooperate with the criminal background investigation is grounds for denial of an application or may result in revocation of a license. examinations;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(3)    Order, perform, and interpret diagnostic procedures;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(4)    Order and perform therapeutic procedures;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(5)    Plan and initiate therapeutic regimens that involve ordering and prescribing non-pharmacological interventions;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span xml:space="preserve" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(6)    Order, prescribe, dispense, and administer medical devices, legend drugs, and prescription drugs not listed in § </span><a class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(7)    Respond to emergencies and institute emergency treatment measures;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(8)    Write a chemical or physical restraint order if the patient may do personal harm or harm others;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(9)    Complete and sign birth and death certificates and other official documents required by law;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(10)    Take x-rays and perform radiologic procedures;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(11)    Perform physical examinations for participation in athletics and certify that the patient is healthy and able to participate in athletics;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(12)    Certify the health or disability of a patient, as required by any local, state, or federal program;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(13)    Educate patients on health promotion and disease prevention;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(14)    Write medical orders;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(15)    Obtain informed consent;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(16)    Assist in surgery;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(17)    Perform routine clinical office surgical procedures;</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(18)    Supervise, delegate, and assign therapeutic and diagnostic measures to assistive personnel; and</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0StatuteNumber1"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">(19)    Provide consultation upon request.</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0Statute"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">Whenever a physician assistant orders, prescribes, dispenses, or administers drugs and medical devices, as permitted by subdivision (6), the physician assistant shall ensure that medications or sample drugs provided to a patient are accompanied by written administration instructions, and the physician assistant shall enter appropriate documentation in the patient's record. A physician assistant may request, receive, and sign for professional samples of drugs provided by the manufacturer.</span></p><p dir="ltr" class="s9cbc3d67ddda4c8f9e7e0af4041b4af0Statute"><span class="s9cbc3d67ddda4c8f9e7e0af4041b4af0DefaultParagraphFont">A physician assistant shall collaborate with other health care providers and refer or transfer patients, as necessary and appropriate.
