All business development rates shall be approved as being in the public interest under such terms and conditions as the commission may provide in a proceeding under this chapter. If approved, no such business development rate constitutes a violation of § </span><a href="https://sdlegislature.gov/Statutes/Codified_Laws/DisplayStatute.aspx?Type=Statute&amp;Statute=49-34A-3"><span class="s2070682DefaultParagraphFont">49-34A-3</span></a><span xml:space="preserve" class="s2070682DefaultParagraphFont"> or a change in rates pursuant to § </span><a href="https://sdlegislature.gov/Statutes/Codified_Laws/DisplayStatute.aspx?Type=Statute&amp;Statute=49-34A-12"><span class="s2070682DefaultParagraphFont">49-34A-12</span></a><span class="s2070682DefaultParagraphFont">.
