No misrepresentation, omission, concealment of fact, or incorrect statement prevents a recovery under the policy or contract unless:</span></p><p dir="ltr" class="s2074564Normal-000001"><span class="s2074564DefaultParagraphFont">(1)    Fraudulent or an intentional misrepresentation of a material fact;
