NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

DEPARTMENT OF EDUCATION AND CULTURAL AFFAIRS: BOARD OF EDUCATION: (February 22, 2000) is proposing rules to ensure that state special education and early intervention policies and procedures are consistent with the Individuals With Disabilities Education Act as amended in 1997. The rules also update or clarify certain state-specific policies and procedures. The general authority for these rules, as cited by the department, is SDCL 13-1-12.1, 13-32-1, 13-32-4, 13-37-1, 13-37-1.1, 13-37-28, and 13-37-31.

A public hearing will be held on March 21, 2000, at 8:30 a.m.(MST), at Western Dakota Technical Institute, Mickelson Building, Multi-purpose Rooms A-B-C-D, Rapid City, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to the Department of Education and Cultural Affairs, South Dakota Board of Education, 700 Governors Drive, Pierre, South Dakota 57501-2291. Material sent by mail must reach the department by March 17, 2000, to be considered. This hearing is being held in a physically accessible place and interpreter services will be provided during this hearing. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3426 at least forty-eight hours before the hearing.

DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES: ENVIRONMENTAL SERVICES: (February 23, 2000) is proposing rules to comply with federal regulations pertaining to air quality standards, portland cement manufacturing facilities, and pesticide active ingredient production. The general authority for these rules, as cited by the department, is SDCL 34A-1-6, 34A-1-12, 34A-1-15, and 34A-1-18.

A public hearing will be held on March 16, 2000, at 10:15 a.m., in the Matthew Environmental and Training Center, Foss Building, 523 East Capitol, Pierre, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to Brian Gustafson, Department of Environment and Natural Resources, Foss Building, 523 East Capitol, Pierre, South Dakota 57501. Material sent by mail must reach the department by March 15, 2000, to be considered. This hearing is being held in a physically accessible place and interpreter services will be provided upon request. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-7171 at least forty-eight hours before the hearing.

DEPARTMENT OF TRANSPORTATION: TRANSPORTATION COMMISSION: (February 25, 2000) is proposing rules to amend speed zones in Brown and Davison Counties. The general authority for these rules, as cited by the department, is SDCL 32-25-7.

A public hearing will be held on March 23, 2000, at 9:05 a.m. (CST), in the Commission Room, Becker-Hansen Building, 700 East Broadway, Pierre, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to the Secretary of Transportation, Room 202, Becker-Hansen Building, 700 East Broadway, Pierre, South Dakota 57501-2586. Material sent by mail must reach the department by March 22, 2000, to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3265 at least forty-eight hours before the hearing.

Executive Appointments:

Larry E. Gabriel, Cottonwood, was appointed February 23, 2000, as Secretary of the Department of Agriculture, effective May 1, 2000, and to continue at the pleasure of the Governor.

Rules Review Committee Meetings

The next meeting of the Interim Rules Review Committee will be held Wednesday, April 19, 2000, in Legislative Conference Room 1 and 2 of the State Capitol, Pierre, starting at 9:00 a.m. The committee chair has set the following tentative meeting schedule for the 2000 interim: June 7, July 11, August 16, September 12, October 18, November 14, and December 12. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
