NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Commerce and Regulation: State Banking Commission: (March 8, 1999) intends to adopt rules to allow state chartered banks to borrow money for longer than

temporary periods under certain conditions. The general authority for these rules, as cited by the department, is SDCL 51A-4-13.

A public hearing will be held at the Division of Banking Office, 217 ? West Missouri, Pierre, South Dakota, on April 1, 1999, at 10:00 a.m. (CST). Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Department of Commerce and Regulation, Division of Banking, 500 East Capitol, Pierre, South Dakota 57501-5070. Material sent by mail must be received by March 22, 1999, to be considered. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3421 at least 48 hours before the hearing.

Secretary of State: Board of Finance: (March 12, 1999) is proposing rules to increase per diem rates, allowance rates for use of privately owned automobile and private airplane for State of South Dakota employees traveling on official business. The general authority for these rules, as cited by the department, is SDCL 3-9-1 and 3-9-2.

A public hearing will be held in the Governor's Large Conference Room, 2nd Floor, State Capitol, Pierre, South Dakota, on April 20, 1999, at 2:00 p.m. (CST). Copies of the proposed rules may be obtained from and written comments sent to the Secretary of State, 500 East Capitol, Pierre, South Dakota 57501. Material sent by mail must be received by April 20, 1999. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3537 at least 48 hours before the hearing.

Executive Appointments:

Michael V. Braley, Parkston, was reappointed on March 8, 1999, to the South Dakota Lottery Commission, effective immediately and to continue until January 1, 2002.

Frances S. Lamont, Aberdeen, was reappointed on March 8, 1999, to the South Dakota Advisory Council on Aging, effective immediately and to continue until December 31, 2002.

Ralph A. Kemnitz, Philip, was reappointed on March 8, 1999, to the South Dakota Lottery Commission, effective immediately and to continue until January 1, 2002.

Executive Orders:

Executive Order 99-01, dated March 5, 1999, directs additional duties for the South Dakota Development Corporation (SDDC). The SDDC will become an advisory board for various economic development assistance activities, it is authorized to become a charitable tax exempt organization, it may accept gifts for the purpose of economic development, it may accept the microloan program extended to it by Citibank, and it may amend its Articles of Incorporation and Bylaws to reflect these responsibilities. The Governor's Office of Economic Development will assist the SDDC to implement this Executive Order.

The following agencies have permission from the Interim Rules Review Committee to charge for adopted rules: the Division of Insurance, the Cosmetology Commission, the State Board of Examiners in Optometry, the State Plumbing Commission, the Board of Nursing, the Department of Social Services, the State Electrical Commission, the South Dakota Board of Pharmacy, the Real Estate Commission, the Gaming Commission, the Department of Commerce and Regulation for commercial driver licensing, the Department of Labor for Article 47:03, and the Department of Revenue.
