NOTICES OF PROPOSED RULES (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Agriculture: South Dakota State Fair Commission (April 22, 1998) intends to change the hours the gates of the fair will be open and the hours admission will be charged to the public; the hour of release for livestock, commercial exhibits, concessionaires, and competitive exhibits on Labor Day; and the hour for dismantling exhibits on Labor Day. The general authority for these rules, as cited by the agency, is SDCL 1-21-10.

A public hearing will be held on May 15, 1998, at 10:00 a.m., in the Commission Meeting Room, Administration Building, South Dakota State Fairgrounds, 890 Third Street SW, Huron. Written comments may be sent to the South Dakota State Fair, Administration Building, P.O. Box 1275, 890 Third Street SW, Huron, South Dakota 57350-1275, and must be received by May 15, 1998, to be considered. Copies of the rules may be obtained from the same address. Department of Transportation: South Dakota Transportation Commission (April 23, 1998) intends to revise a speed zone in McPherson County on State Trunk Highway 45 through Leola. The general authority for this rule, as cited by the agency, is SDCL 32-25-7.

A public hearing will be held on May 28, 1998, at 9:00 a.m., in the Commission Room, Becker-Hansen Building, Pierre. Written comments may be sent to the Secretary of Transportation, 700 East Broadway Avenue, Pierre, South Dakota 57501, and must be received by May 28, 1998, to be considered. Copies of the rules may be obtained from the same address. Persons who have special needs for which the agency can make arrangements are asked to call (605) 773-3265 before the meeting.

FILINGS IN THE SECRETARY OF STATE'S OFFICE:

Executive Orders:

Executive Order 98-04, dated April 20, 1998, directs that the Governor's Dakota, Minnesota and Eastern Railroad Oversight Committee be established. The committee shall review the development and expansion of the DM&E Railroad and its application to the Surface Transportation Board for the construction of new railroad line from Wasta into the Wyoming coal fields and the improvement of railroad line from Wasta to the Minnesota border. The committee shall report its finding, recommendations, or information from its meetings regularly to the Governor and shall make a final report to the Governor when the Surface Transportation Board approves or denies the application submitted by the DM&E Railroad. The committee will dissolve and cease to exist upon completion of the report.

RULES REVIEW COMMITTEE MEETING:

The next meeting of the Interim Rules Review Committee will be held June 22, 1998, in Rooms LCR 1 and 2, Third Floor, State Capitol, Pierre, starting at 9:00 a.m. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.

Each agency is requested to provide the LRC with nine copies of the most recent draft of its rules two days before the meeting.
