NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Commerce and Regulation: Board of Accountancy: (November 4, 1999) is considering rules to define initial and reexamination applicants, increase exam fees, clarify procedures and evaluator qualifications for disability accommodation requests, outline and clarify use of the CPA or PA designation when an individual does not hold a permit to practice, provide for admission of an exam candidate previously expelled for misconduct, clarify rules of professional ethics, and update references. The general authority for these rules, as cited by the board, is SDCL 36-20A-7 and 36-20A-8.

A public hearing will be held in the Legislative Audit Office, 427 South Chapelle, Pierre, South Dakota, on Thursday, December 2, 1999, at 3:00 p.m. to consider the adoption of the proposed rules. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Board of Accountancy, 301 East 14th Street, Suite 200, Sioux Falls, South Dakota 57104, and must be received by November 29, 1999, to be considered. This hearing is being held in a physically accessible place.

Bureau of Administration: (November 5, 1999) is proposing rules to increase the initial purchase cost of public personal property requiring inventory from $1,000 to $5,000 and set fees which may be charged by newspapers for legal publications not otherwise provided for by law. The general authority for these rules, as cited by the board, is SDCL 1-14-12, 5-24-1, 5-24-1.1, and 17-2-19.

A public hearing will be held in Room 413, 4th Floor, State Capitol, 500 East Capitol, Pierre, South Dakota, on Wednesday, December 1, 1999, at 1:00 p.m. to consider the adoption of the proposed rules. Copies of the proposed rules may be obtained from and written comments sent to the Bureau of Administration, 500 East Capitol Avenue, Pierre, South Dakota 57501, and must be received by November 30, 1999, to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the bureau can make arrangements may call (605) 773-3688 at least forty-eight hours before the hearing.

The following are Special Assistant Attorney General appointments:

Lynn Valenti, was appointed September 30, 1999, to represent the Division of Human Services.

Anthony M. Sanchez, was appointed October 1, 1999, to represent the Department of Social Services.

Joan Boos Schueller, was appointed October 20, 1999, to represent the Department of Health.

David W. Siebrasse, was appointed October 20, 1999, to represent the Division of Insurance.

Phyllis M. Heineman, Sioux Falls, was appointed November 2, 1999, to the South Dakota House of Representatives, to replace Dana Windhorst, effective immediately.

Glenn Barber, Rapid City, was appointed November 2, 1999, to the Workers' Compensation Advisory Council, to replace Donald Perdue, effective immediately and to continue until July 1, 2001.

Rules Review Committee Meeting

The next meeting of the Interim Rules Review Committee will be held Tuesday, December 14, 1999, in Legislative Conference Rooms 1 and 2, Third Floor, State Capitol, Pierre, starting at 9:00 a.m. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
