Rule 06:04:01:01 Proof of education.

          6:04:01:01.  Proof of education. Within 30 days after graduating and receiving a degree from a college of veterinary medicine accredited or approved by the American Veterinary Medical Association, the student shall submit evidence of that degree to the state treasurer.

Rule 06:04:01:02 Notice of withdrawal.

          6:04:01:02.  Notice of withdrawal. Within 30 days after withdrawing from a college of veterinary medicine, the recipient shall notify the state treasurer of that withdrawal.

Rule 06:04:01:03 Proof of practice.

          6:04:01:03.  Proof of practice. In addition to the conditions to be met by the student in SDCL 13-49-20.7, each recipient shall submit notarized employment affidavits to the state treasurer at the time employment starts and ends. The employment affidavits must include the following information:

          (1)  The current legal name and residency of the award recipient;

          (2)  The name and address of the employer;

          (3)  Employment status;

          (4)  Date of employment;

          (5)  The signature of the employer or the employer's representative, the signer's title, and the date signed; and

          (6)  The signature of the award recipient.

          Self-employed recipients must submit notarized affidavits to the state treasurer that include a South Dakota sales tax number and the name and address of the business.

Rule 06:04:01:04 Notice of change of address or employment.

          6:04:01:04.  Notice of change of address or employment. The recipient shall notify the state treasurer of any change in address or employment until all conditions of the contract are fulfilled.

Rule 06:04:01:05 Notice of violation of contract and collection of tuition award.

          6:04:01:05.  Notice of violation of contract and collection of tuition award. If the recipient violates a provision of the contract or requests to repay the tuition award for not completing the terms of the contract specified in SDCL 13-49-20.7, the state treasurer shall notify the recipient in writing and demand payment of the amount of the tuition awards and the interest pursuant to SDCL 13-49-20.7. The state treasurer shall send the notice and furnish a promissory note for the recipient to sign for repayment of the loan plus interest charged at the category A rate of interest specified in SDCL 54-3-16. For the purposes of administering SDCL 13-49-20.7 the recipient is in compliance with SDCL 13-49-20.7 by establishing and maintaining residency in South Dakota and by practicing veterinary medicine in South Dakota for a period of years required by SDCL 13-49-20.7(2).

Rule 06:04:01:06 Repayment of award and interest.

          6:04:01:06.  Repayment of award and interest. Repayments are to be made in the following manner:

          (1)  Payments are due on the first day of the month starting in the month which immediately follows 60 days after notification to the recipient of a violation of the contract provisions;

          (2)  Payments must be made monthly to the office of the state treasurer; and

          (3)  Minimum monthly payments are $250 or 1/60 of the deferred principal amount of the award plus accrued interest, whichever is greater.

          If the account is delinquent 120 days following the date the payment is due, the account shall be referred to a collection agency.

Rule 06:04:01:06.01 Procedures for forwarding delinquent account to collection agency -- Commencement of civil action.

          6:04:01:06.01.  Procedures for forwarding delinquent account to collection agency -- Commencement of civil action. If any payment is late by more than 30 days after the date the payment is due pursuant to the promissory note, the state treasurer shall notify the recipient in writing that if payment is not received within 90 days, the recipient's account shall be referred to a collection agency.

          If the account is forwarded to a collection agency for reason of nonpayment and the recipient fails to pay the collection agency, the state treasurer shall notify the recipient that if final payment for the full amount of the tuition awards is not received within 30 days of sending this notice, the state treasurer shall commence a civil action at a time fixed by the state treasurer and subscribing a summons and directing it, with or without complaint, to the recipient. If the recipient is a minor, the state treasurer shall also commence civil action on the recipient's parent or guardian.

          If after 30 days from the date the state treasurer sent written notice to the recipient of intent to bring civil action or the recipient fails to repay the tuition award, the state treasurer shall commence action by service of summons on the recipient as provided in SDCL 15-2-30 and 15-2-31.

Rule 06:04:01:06.02 Payment schedule for early contract violation or if recipient withdraws.

          6:04:01:06.02.  Payment schedule for early contract violation or if recipient withdraws. If it is determined a recipient has violated the contract within one year after graduating or if the recipient withdrew from the college of veterinary medicine, the recipient shall begin payment of the tuition amount and interest no later than the thirteenth month after receiving a degree or withdrawing from the college program.

Rule 06:04:01:07 Extension of award repayment period.

          6:04:01:07.  Extension of award repayment period. The state treasurer may extend the award repayment period if the recipient is unemployed because the recipient is under treatment for physical or mental illness or the recipient's spouse, children, or parents are under treatment for an illness lasting longer than two months.

          The state treasurer may extend the award repayment period for not more than four years if the recipient voluntarily enters the military.

Rule 06:04:01:08 Cancellation of promissory note.

          6:04:01:08.  Cancellation of promissory note. If the loan recipient is totally or partially disabled as defined for social security benefits in 42 U.S.C. § 416(i)(1) as in effect on January 3, 1989, or dies, the state treasurer may defer or cancel the promissory note and accrued interest.
