74:55:01:36.  Confinement of recovery fluid. Recovery fluid shall be restricted to those production zones that have been classified by the board as an exempted aquifer within the area of production zone monitor wells. If recovery fluids migrate outside the production zone or into aquifers above or below the production zone, the operator shall report, monitor, and remediate the excursion in accordance with §§ 74:55:01:50 to 74:55:01:53.02, inclusive. Recovery fluids are assumed to be present in an unauthorized zone if a verifying analysis confirms that a control parameter in a monitor well is detected at a concentration equal to or greater than the upper limit value.
