An Act to prohibit the internet publication of certain land records.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added:

43-28-29. Register of Deeds--Land Record--Publication--Promulgation of rules.

A register of deeds, or a database under § 1-27-45, may not publish or post any land record on the internet for public use without the express consent of the landowner. A land record includes:

(1) Plats;

(2) Deeds;

(3) Mortgages;

(4) Covenants or restrictions;

(5) Appurtenances;

(6) Satisfactions; or

(7) Foreclosures.

The Department of Labor and Regulation shall create a form, promulgated pursuant to chapter 1-26, for a landowner to consent to disclosure of any land records pursuant to this section.
