An Act to prohibit the cancellation or nonrenewal of a health insurance policy for a preexisting condition.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added:

58-17-171. Insurance policy--Preexisting condition.

Notwithstanding any other provision of law, a health insurance policy may not be canceled, nor may renewal be refused, solely based on a preexisting condition of the injured person.
