ENTITLED, An Act  to expand the jurisdiction of magistrate judges to include temporary protection order cases.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
     Section  1.  That chapter 16-12A be amended by adding thereto a NEW SECTION to read as follows:

     Magistrate courts with magistrate judges presiding shall have concurrent jurisdiction with the circuit courts in all matters relating to issuing, hearing, and deciding temporary protection orders.
     Section  2.  That § 25-10-2 be amended to read as follows:
     25-10-2.   An application for relief under this chapter may be filed in circuit court or in a magistrate court with a magistrate judge presiding. Venue lies where any party to the proceedings resides.
