FOR AN ACT ENTITLED, An Act
to increase the minimum wage and to declare an
emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 60-11-3 be amended to read as follows:
60-11-3. Every employer shall pay to each
of his employees
employee
who has reached the
age of eighteen years, wages at a rate of not less than four dollars and
twenty-five

cents an hour. Violation of this section is a Class 2 misdemeanor.

A "tipped employee" is one engaged in an occupation in which

This section does not apply to babysitters or outside salesmen.
Section 4. The provisions of section 2 of this Act are effective on September 1, 1997.
Section 5. Whereas, this Act is necessary for the immediate preservation of the public peace, health, or safety, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after April 1, 1997.
