FOR AN ACT ENTITLED, An Act
to revise certain requirements for snow removal equipment
and to declare an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 32-14-12 be amended to read as follows:
32-14-12. The provisions of § § 32-22-2 and 32-22-3 do not apply to any road grader, snowplow or snow removal equipment which does not exceed a width of thirteen feet and ten inches and which is being operated under contract to, or leased by, the state, a county, a township, municipality , or a school district , or which is being operated within the corporate limits of a municipality . Any such equipment shall be equipped with revolving lights and any overwidth item shall be equipped with red or orange flags. Such equipment may not operate during nighttime hours except when used for snow removal purposes.
Section 2. Whereas, this Act is necessary for the immediate preservation of the public peace, health, or safety, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
