FOR AN ACT ENTITLED, An Act
to repeal certain restrictions on agricultural leases of school
and public lands.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 5-5-9 be repealed.
5-5-9.
Not more than six hundred forty acres shall be leased for agricultural purposes to any
one person, firm, or corporation. The commissioner of school and public lands shall approve
no lease for agricultural purposes unless the lessee has subscribed and sworn to an affidavit
setting forth the fact that he is not, either directly or indirectly, the lessee of more than six
hundred forty acres of common school or endowment lands for agricultural purposes, including
the land applied for.
