FOR AN ACT ENTITLED, An Act
to repeal certain provisions regarding medication aides.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That subdivision (6) of § 36-9-28 be repealed.

Section 1. That subdivision (6) of § 36-9-28 be repealed.

The administration of medications, other than by the parenteral route, by medication
aides within nursing homes, supervised living facilities, health care facilities under
the jurisdiction of the department of human services, and other penal and treatment
centers within the state, when under the direct or indirect supervision and review of
a person licensed by this chapter. Supervision may be by personal contact or indirect
contact through a communication media such as telephone or radio. The complete act
of administration entails removing an individual dose from a previously dispensed,
properly labeled container including a unit dose container, verifying it with the
physician's orders, giving the individual dose to the proper patient, and promptly
recording the time and dose given;

The term "medication aide" means a person duly authorized under this section
to administer medication. The department of health shall, in compliance with chapter 1-26,
adopt and publish minimum standards relative to the training and qualifications of a medication aide.
