FOR AN ACT ENTITLED, An Act
to create a workers' compensation scholarship fund.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 62-4 be amended by adding thereto a NEW SECTION to read as follows:

The state treasurer shall establish a workers' compensation scholarship fund to provide
scholarships for the spouses and dependent children of employees who die as a result of
compensable work-related injuries if the dependents are entitled to benefits pursuant to this
chapter. Scholarships are payable to accredited postsecondary education institutions in South
Dakota on behalf of the dependent students attending the institutions. The workers'
compensation scholarship fund is designated as a participating fund for interest purposes.
Eligible dependents may qualify for a maximum of two thousand dollars per year, while
attending a postsecondary education institution. No student may receive assistance pursuant to
this Act for more than five years. The secretary of the Department of Labor shall promulgate
rules, pursuant to chapter 1-26, to implement this Act.
