FOR AN ACT ENTITLED, An Act to
revise the responsibility for supervising the arrangement
on how the candidates' names are listed on the ballot.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 12-16-8 be amended to read as follows:
12-16-8.
When
If
there is more than one candidate seeking nomination or election for the
same office in any column, the names of candidates for that office shall be arranged by lot, under
the supervision of the
county auditor, if such candidates can be voted for only in one county or
district therein, and by the secretary of state in case such candidates can be voted for in more
than one county. Such candidates shall have
election official in whose office the candidates'
nominations were filed. Each candidate has
the right to be present or represented when
such
the
arrangement is being determined.
