FOR AN ACT ENTITLED, An Act to
revise certain provisions regarding access to the state
trunk highway system.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 31-24 be amended by adding thereto a NEW SECTION to read as follows:

Any property owner adjacent to a state highway shall notify the Department of
Transportation, as abutting owner, of any pending platting, zoning, subdivision, or site plan
action. Local government approval of any necessary permit, zoning, or platting may not be
granted until the department provides concurrent approval of any setback or access or both to
the state highway if access is required.

The department may promulgate rules, pursuant to chapter 1-26, for the issuance and
modification of access permits, closing of nonpermitted connections, revocation of permits for
access to state highways, and establishing access management standards. Access management
standards shall include connection location standards, safety factors, design and construction
standards, traffic control devices, and effective maintenance of the roads. The standards shall also contain criteria for the spacing of connections, intersecting streets, roads, and highways.
