FOR AN ACT ENTITLED, An Act to
authorize the Board of Examiners of Psychologists to
dismiss certain complaints.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 36-27A be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 36-27A be amended by adding thereto a NEW SECTION to read as follows:
If the board determines that any complaint was frivolous or clearly unfounded in fact, the
board may dismiss the complaint and, by separate and unanimous vote of the board, may
expunge the record of the licensee.
