FOR AN ACT ENTITLED, An Act to
extend the time for filing of the record in certain school
appeals.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 13-46-4 be amended to read as follows:
13-46-4. Upon such appeal so taken, the business manager of the school district or the acting clerk of such special committee, shall, within
five
thirty
days thereafter, transmit to
said
the
clerk
of courts a certified copy of the record of the decision appealed from and of the record of all
proceedings had in respect to
said
the
matter and all original papers filed in
his
the
office and
upon the failure of such person so to transmit
said
the
record
he may be compelled by
,
the circuit
court
so
may compel the person
to do
so
and may
be fined
fine the person
for neglect or refusal
to transmit the
same
record
. Such officer or clerk shall receive the usual copying fees to be taxed
as part of the costs of suit.
In the event a transcript of hearing or other proceeding is part of the
record to be transmitted and is not available within the time limit established in this section, it
shall be submitted to the court within five days of receipt from the reporter.
