FOR AN ACT ENTITLED, An Act to
provide transportation allowances for certain students
attending schools outside the resident school district.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 13-30 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 13-30 be amended by adding thereto a NEW SECTION to read as follows:
If any school district closes an elementary or secondary school after July 1, 1996, any student
who would otherwise have been assigned to the school that was closed is entitled to allowances
for transportation, room, and board as provided in
§
13-30-1 for school attendance in a district
other than the student's resident school district if the school in the nonresident district is closer
to the student's residence than the closest school in the student's resident school district. The
allowance for any such student shall be paid by the resident district, including cases in which the
student is enrolled in the nonresident district pursuant to
§
13-28-40. Any allowance authorized
pursuant to this Act shall be paid for the 1998-1999 school year and for each school year
thereafter.
