FOR AN ACT ENTITLED, An Act to
prohibit the launching of boats from public highways
under certain circumstances and to provide penalties therefor.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 42-8 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 42-8 be amended by adding thereto a NEW SECTION to read as follows:
No person may launch any boat, either by hand or by any trailer, motor vehicle, or other
mechanical device, from any public highway, as defined in
§
31-1-1. The provisions of this
section do not apply to any law enforcement officer or employee of the Department of Game,
Fish and Parks if engaged in the performance of official duties.
A violation of this section is a Class 2 misdemeanor. Any person who damages any public
highway while launching a boat in violation of this section is liable for any damages resulting
either directly or as the proximate cause of such act.
