FOR AN ACT ENTITLED, An Act to
exempt from penalty certain vehicles that became
overweight as a result of snow or ice accumulations.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 32-22 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 32-22 be amended by adding thereto a NEW SECTION to read as follows:
No vehicle is subject to penalty as an overweight vehicle or penalty for any violation of
weight restrictions under this chapter if the owner or operator of the vehicle can demonstrate
that the vehicle was within legal limits when it was loaded and that any excess weight is the result
of the accumulation of snow or ice on or in the vehicle that occurred as the result of a natural
weather event.
