BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. The Commissioner of School and Public Lands is hereby authorized on behalf of the Board of Regents to sell and convey to the South Dakota Department of Transportation at appraised value, approximately forty-seven thousand, three hundred twenty-five dollars ($47,325), a parcel of property consisting of 18.93 acres, more or less, described as lot A in the NW 1/4 of the NW 1/4 of section 22, township 110 North, range 50 West of the Fifth Prime Meridian in Brookings County, South Dakota.
Section 2. The proceeds of the sale authorized by this Act shall be deposited in a Board of Regents fund pursuant to § 5-2-2.3.
Section 3. Sale proceeds approximating forty-seven thousand, three hundred twenty-five dollars ($47,325), plus other funds not to exceed three hundred thousand dollars ($300,000), or so much thereof as may be necessary, are hereby appropriated to the Board of Regents to purchase property for research and other uses that is suitable as replacement property in the immediate vicinity of the research farm, and described as the East one-half of the Southwest Quarter of Section Thirteen, except Second Substation Addition to the City of Brookings, and except lot H-1 thereof, and except highway right-of-way thereof; West one-half of the Southeast Quarter of Section Thirteen, except the West three hundred seventy-one feet of the East five hundred forty-eight feet of the South two hundred seventy-six feet thereof and except lot H-1 thereof, and except highway right-of-way thereof; all in township 110 North, range 50 West of the Fifth Prime Meridian, the South five hundred
feet of which lie within the City of Brookings, Brookings County, South Dakota; all subject to the
right of the owners of the West three hundred seventy-one feet of the East five hundred forty-eight
feet of the South two hundred seventy-six feet of the West one-half of the Southeast Quarter to
continue with the use of the existing waterline over the East one-half of the Southwest Quarter and
the West one-half of the Southeast Quarter thereof.
Section
4.
If the property described in section 1 of this Act is no longer of use to the Department
of Transportation or its successor agency and the property is deemed surplus by the Department of
Transportation, the property as described in section 1 of this Act shall be returned to the Board of
Regents for the appraised value.
Section
5.
Whereas, this Act is necessary for the support of the state government and its existing
public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and
effect from and after its passage and approval.
An Act to authorize the sale of a tract of land in Brookings County, South Dakota, to provide for the disposition and appropriation of the sale proceeds, to authorize and appropriate other funds to the Board of Regents to purchase property for agricultural experiment station research, and to declare an emergency.
